8(a) certification requirements and application steps

The 8(a) program is for qualifying socially and economically disadvantaged businesses. Individually owned applicants must show qualifying ownership and control, small-business size and potential for success. The program can last up to nine years.

Individually owned and entity-owned applicants

For an individually owned business, at least 51% must be owned and controlled by qualifying socially and economically disadvantaged U.S. citizens. SBA also examines size, character, prior participation and the business’s potential for success. Entity-owned applicants follow different requirements; the requirements below describe individually owned businesses. SBA certification programs ↗.

Admission lasts a maximum of nine years, subject to continuing eligibility. Certification does not promise a contract, and 8(a) is not a general certificate for every minority-owned business.

Social-disadvantage rules changed in September 2026

SBA stopped using the group-based rebuttable presumption after the 2023 court order. The rule that took effect on 10 September 2026 is a further change for individually owned applicants, including pending applications. These are two distinct changes; group membership does not automatically establish eligibility under the revised rule. 2026 8(a) final rule ↗.

The current standard requires evidence of the specified discrimination or bias, along with certifications about group membership and material harm. The application questions and 13 CFR 124.103: social disadvantage ↗ explain what SBA requires. Whether a person’s account satisfies that standard must be assessed through the official process.

This revision does not apply to entity-owned applicants. Businesses already admitted to 8(a) also have different instructions from applicants still awaiting a decision.

Personal finances: what the $850,000 limit means

The personal-net-worth requirement is below $850,000. Exactly $850,000 is outside that limit. The regulation specifies exclusions and separately addresses income, assets and certain transfers; an exclusion allowed in the net-worth calculation cannot simply be carried across to every other test. Prepare the financial records requested by SBA using the treatment for each test. Entering three totals into a calculator would leave those distinctions unanswered, so our planning tools do not give a financial-eligibility verdict.

Two years of operating history—or a supported waiver

SBA’s September FAQ asks for two tax years of business returns showing operating revenue and proof of two full years of contract performance in the primary NAICS without gaps. A company’s formation date alone does not demonstrate that history. SBA potential-for-success FAQ ↗.

A waiver requires support for all five conditions: substantial management experience, technical experience, adequate capital, successful performance and access to the resources needed to perform. If your records leave one condition unclear, identify that gap before submitting the application.

Submitting through MySBA

  1. Complete official onboarding after checking SAM registration, NAICS and size.
  2. Open the application in MySBA and select the programs you are applying for.
  3. Answer the questionnaires and upload the documents requested for your business.
  4. Have contributors complete their tasks when required. Changes to the application can require new invitations.
  5. Review, sign and submit the application. Save the confirmation and respond to any further SBA requests.

If SBA returned your pending 8(a) application

For the individually owned pending applications covered by SBA’s September 2026 FAQ, you have 45 calendar days from the Return to Business notification to update the application. Count from your own notification date, not from the rule’s effective date.

  1. Open the MySBA notification and save its date and instructions.
  2. Update the requested business and financial records, questionnaire answers and contributor information. Complete any required contributor tasks.
  3. Go to the final application page and resubmit. Editing a draft alone does not restart processing.
  4. Save the submission confirmation. If the period has passed or the status is unclear, check MySBA and contact official help before assuming the application remains open.

Annual review after admission

8(a) participants must continue to meet the requirements and complete annual review.
